In late 2024, our client Mr. X, a talent management entrepreneur who has asked to remain anonymous in this case study, engaged with us to pursue an O-1B visa in the category of extraordinary ability in the arts. This was done by Mr. X in an effort to relocate his growing talent management business from Australia to the United States. In just a few years, Mr. X had built one of his home market's most recognized boutique talent management agencies, representing a roster of top-tier social media creators with a combined audience of over 150 million followers across 5 platforms. Throughout his career, Mr. X had found great success both managing these creators and negotiating high value brand sponsorships for them. We knew this fact would be beneficial going forward.

The mission

The petition needed to demonstrate that Mr. X had achieved a level of skill, recognition, and professional accomplishment substantially above that ordinarily encountered in his field. We had to prove that his work was sufficient to qualify him as an individual of extraordinary ability in the arts under the O-1B classification.

The main challenge was framing the petition. Mr. X was not himself a performer or on-camera talent, but an entrepreneur and manager operating at the intersection of entertainment, media, and marketing. Our team needed to establish that his leading and critical role in discovering, developing, and directing the careers of leading digital creators, and in structuring their commercial partnerships with globally recognized platforms and brands, constituted extraordinary ability within the entertainment and digital media field.

The strategy

At an initial consultation in mid-2024, our team reviewed O-1, E-2, and E-3 options given Mr. X's Australian citizenship, his plans to establish a U.S.-based LLC, and his intent to relocate key members of his creator roster alongside him. We advised that an O-1B petition, filed through a U.S. agent given the project-based nature of his work, offered the strongest and fastest path forward. From there, the team built a petition anchored across several of the six O-1B evidentiary criteria:

  • Lead and critical role for organizations of distinguished reputation: established through showing Mr. X's leadership of his talent agency, which represented creators with a combined social media following of over 150 million and secured partnerships with globally recognized social media platforms and major entertainment studios on their behalf.
  • National and international recognition: established by showing coverage of Mr. X's career across major Australian and international media outlets, an appearance on a national television program to discuss his career, and his selection as a contributing commentator for a major global financial and business media platform on entrepreneurship and the creator economy.
  • Significant recognition from organizations and industry experts: established by documenting Mr. X's invitation to an exclusive, invitation-only recognition program for professional voices in his field. This was an honor extended to only one talent manager nationally. He was also selected as a panel speaker at a major social media platform's industry event.
  • Record of commercial success: established through documents showing Mr. X's agency achieving approximately 300% year-over-year revenue growth, his direct role in social-impact marketing campaigns that raised over $1,000,000 for charitable causes through influencer partnerships, and his prior work growing a consumer brand's social media following to over one million collective followers.

Building this record required close coordination with Mr. X to document his business achievements, media coverage, and industry recognition into a cohesive extraordinary-ability narrative. We compiled supporting letters, revenue and growth documentation, and press materials into the package to further strengthen his case. Due to Mr. X’s work focussing on brand deals, the petition was filed through a U.S. agent and supported by deal memoranda and letters confirming his continued engagements.

The petition was filed under premium processing in late December 2024.

Outcome

The O-1B petition was approved three weeks after filing. The approval reflected both the strength of the supporting record and the efficiency of premium processing. While O-1B applicants don’t always need such an incredible resume, it certainly helped in the case of Mr. X.

Mr. X is now authorized to continue building his talent management business in the United States, relocating key members of his creator roster, expanding his brand and studio partnerships, and continuing his work at the forefront of the digital talent and creator economy. It was a pleasure to work with Mr. X, and we wish him continued success in his growing business!
